CAN MY LENDER COME AFTER ME FOR THE DIFFERENCE?
In California, your lender cannot come after you for the deficient amount after agreeing to do a short sale meaning banks will forgive the remaining balance after a Short Sale. This is due to CA Civil Code 580e enacted by CA Senate Bills 931 and 458.
WILL I HAVE TO PAY TAX ON THE FORGIVEN DEBT AFTER THE SALE?
Every situation is different so it is important to consult with a tax professional in order to assess your tax liability prior to completing a short sale. After a short sale the lender will issue you a form 1099-C for the cancelled debt which your tax professional will need.
HOW MUCH WILL A SHORT SALE COST ME?
Fees associated with a short sale including commissions and seller costs will be paid out of the proceeds of the sale. You will not have any out of pocket expenses for our services. You will need to keep your HOA dues current and the utilities on through the close of escrow.
